News - Men face costly fine for undersized swordfish

News Release
Men face costly fine for undersized swordfish

March 6, 2009
Contact: Gabriella B. Ferraro, 772-215-9459

That's some expensive fish. Taking three undersized swordfish may end up costing four Broward County men $10,000. The National Oceanic and Atmospheric Administration issued a "notice of violation and assessment" to the owner, permit holder, boat operator and fisherman of the fishing vessel "No Mercy."

The case was referred to NOAA by the Florida Fish and Wildlife Conservation Commission (FWC). In December, FWC Officer David Weiss stopped a commercial fishing boat in the Intracoastal Waterway near Port Everglades.

Weiss performed a marine fisheries inspection. Two men -- a captain and a fisherman -- were on board at the time. The men had caught six swordfish, three of which were under the legal length and weight limits, Weiss reported. Federal regulations specify a minimum length of 29 inches from cleithrum to caudal keel or 33 pounds dressed. If in whole condition, the swordfish must be 47 inches long, lower jaw fork length.

"We hope this case serves as deterrence," said FWC Lt. Dave Bingham. "Taking undersized swordfish has costly consequences."

Four people are facing federal fisheries law violations. The men are identified as the captain, Michael J. Macneir, DOB 12/2/80, of Fort Lauderdale; fisherman Shane T. Casey, DOB 12/21/82, of Fort Lauderdale; permit holder Vincent T. Bonura III, DOB 4/8/84, of Fort Lauderdale; and vessel registrant Scott M. Leon, DOB 7/24/70, of Davie

People should understand that these guys are not representative of most fisherman in our community. Fortunately, the vast majority of fisherman obey the rules and regulations. Hope they get what they deserve

So how old are you night crawler?

Do you remember the 70's? Hang 10, smiley faces, Conch limits in Florida, and Nassau grouper too, big swordfish (although I did not even know what a swordfish was back then - Kenny will probably get a laugh out of that one)

Citizen Band and C.W. McCall

Yeah, $10k is a pretty serious fine. I would imagine that will deter them in the future even if they don't get inspected too often.

The Guy that owns the boat Scott Leon I am told by a very reliable source that happens to be in my office knows him .... Without saying what happened heres the reference and its not my words :

"Scott leon the regestered boat owner is a dick , he had a charter boat, a bait bussiness and general all around putz." " This time they just got caught !!"

They should really burn um

" Its time to stop living by the Words, " They didnt save the buffalo for me"

There is no excuse for taking shorts

Keeping shorts was just stupid. A 25 lb fish that you will get 1.50 maybe for. So for an extra $75 they got a $10,000 fine. He might have to sell that permit to pay the fine.

no one thinks of the penalty ( or considers getting caught) when they do the crime.

Eric is quite correct, they are going to lose far more than they would have gained. Thankfully, the vast majority of anglers abide by the law and respect this very important fishery so we can continue to have it for the future. Their actions was just plain stupidity.
