Here is the 2004 Florida Statute that applies to the use of explosives and firearms. The statute should be valid until the updated 2005 statutes are published.


(5) THROWING EXPLOSIVES OR USE OF FIREARMS IN WATER FOR PURPOSE OF KILLING FOOD FISH PROHIBITED.--No person may throw or cause to be thrown, into any of the waters of this state, any dynamite, lime, other explosives or discharge any firearms whatsoever for the purpose of killing food fish therein. The landing ashore or possession on the water by any person of any food fish that has been damaged by explosives or the landing of headless jewfish or grouper, if the grouper is taken for commercial use, is prima facie evidence of violation of this section.

Notice that the wording is specifically applied to FOOD fish.

I would interpret this to mean that I could not shoot a Mako shark or drop a stick of dynamite in the water to subdue it since it is considered good eating and generally used as a food fish. No bang sticks either.
So if you use explosives or firearms on any fish, make sure you do not harvest that fish for food: it might be a reach but is still technically correct.

This is the Florida Statute. I still have not rooted out any Federal Regulations on the matter, which will likely apply beyond the 3-mile limit.

Still have not found anything on Flying-gaffs and Harpoons. If I do, I will start another topic post. RT

Regardless of any technicallity why (in the eyes of the law) would you take a fish for anything but food? There aren't too many fish out there that are inedible. They may not be tasty but they're still edible. Just use a gaff...
