Rule 3
The term "vessel engaged in fishing" means any vessel fishing with nets, lines, trawls, or other fishing apparatus which restrict maneuverability, but does not include a vessel fishing with trolling lines or other fishing apparatus which do not restrict manageability.


Buoys free floating in the water do not restrict their vessel's maneuverability. My interpretation is that they are considered a normal power vessel when not actively engaged in the actual setting or pulling of a line at that particular time. Running 1/4 mile up/down stream to set or check a buoy rig would not constitute a 'right of way'.
